PUBLIC NOTICE NOTICE Notice is hereby given that KEFO Corporation P.O. Box 418, Meadville, PA 16335, is requesting a stage I and II, (final), bond release from the Pennsylvania Department of Environmental Protection for the surface mine permit No. 20820307 known as the “Well Rocks Shale Pit”. This permit is located in Summit Township, Crawford County, on the east side of Route 18, approximately two miles north of Harmonsburg, PA. More specifically, the proposed bond release area is located along the east side of Route 18, approximately 1600 feet north of the intersection of Route 18 and Agnew Road. The bond release area is located on the property of Robert George Agnew. A Stage I and II (final) bond release is requested for SMP # 20820307 for 5.5 acres. The area proposed for bond release has been backfilled, graded, topsoil replaced and vegetation established which meets the specifications of the approved permit. The amount of bond presently in affect is $10,000.00, which is also the amount requested to be released. The application, plans and other data concerning this operation for which bond release is requested are available for public inspection at the Bureau of Surface Mining and Reclamation, Pennsylvania Department of Environmental Protection, White Memorial Building, P.O. Box 669, Knox, PA 16232 between the hours of 8:00 A.M. and 4:00 P.M., Monday thru Friday. Any such person who desires to object, request for informal conferences or public hearings or any written comments should write to the PA Department of Environmental Protection, Bureau of Surface Mining and Reclamation at the above address. The objection must include the person’s name, address, telephone number and a brief statement as to the nature of his or her objection. PUBLIC NOTICE NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST THE RELEASE OF FUNDS Date of Notice: August 26, 2019 Name of Responsible Entity: Crawford County Board of Commissioners 903 Diamond Park Meadville, PA 16335 814-333-7341 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Crawford County Board of Commissioners. Request for Release of Funds On or about September 10, 2019 the Crawford County Board of Commissioners will submit a request to the Department of Community and Economic Development (DCED) for the release of Community Development Block Grant (CDBG) funds under Title 1 of the Housing and Community Development Act of 1974 , as amended, to undertake two projects known as Adam’s Place Acquisition, for the purpose of acquiring property for the development of 39 elderly housing unit in Cochranton Borough, Crawford County and Water/Sewer Extension, for the purpose of extended these utilities to the Adam’s Place property. Funding of $205,000 has been allocated from FFY2018 CDBG funding. Finding of No Significant Impact The Crawford County Board of Commissioners has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Crawford County Planning Office, 903 Diamond Park, Meadville, PA 16335 and may be examined or copied weekdays 8:30 A.M. to 4:30 P.M. Public Comments Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Crawford County Planning Office. All comments received by September 10, 2019 will be considered by the Crawford County Board of Commissioners prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. Release of Funds The Crawford County Board of Commissioners certifies to DCED that Francis F. Weiderspahn, Jr., in his capacity as Chairman of the Board of Commissioners, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. DCED’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Crawford County Board of Commissioners to use Program funds. Objections to Release of Funds DCED will accept objections to its release of funds and the Crawford County Board of Commissioners’ certification for a period of 15 days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Crawford County Board of Commissioners; (b) the RE has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by DCED; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to Department of Community and Economic Development, Center for Community Building, 4th Floor Commonwealth Keystone Building, Harrisburg, PA 17120-0225. PUBLIC NOTICE NOTICE OF PROPOSED ADOPTION OF ORDINANCE ESTABLISHING VEHICLE WEIGHT LIMITS ON CERTAIN COUNTY-OWNED BRIDGES The Board of Commissioners of Crawford County hereby provides public notice of the Board’s consideration of a proposed Ordinance to establish vehicle weight limits on certain county-owned bridges (the “Ordinance”), to be considered at the Commissioners’ public meeting on September 11, 2019. The terms of the Ordinance are summarized as follows: Section 1 – Recites legal authority for Ordinance and states the title thereof Section 2 – Incorporates Appendices I and II listing and describing the bridges to which the Ordinance applies and their maximum weight restrictions; states that it shall be unlawful to operate on such bridges any vehicle combination having a gross weight in excess of the maximum weight prescribed for each bridge Section 3 – Establishes that the County may, pursuant to legal authority, prohibit or restrict (either by number or weight) certain kinds or classes of vehicles on County bridges when an engineering evaluation establishes the need for such prohibitions or restrictions based on a structural analysis, rating computation, testing, engineering judgment, or a combination thereof; lists certain conditions warranting bridge restrictions Section 4 – States that the Board of Commissioners may issue permits or enter into agreements allowing a vehicle, or vehicles, to exceed the posted weight restriction for a County-owned bridge in certain cases; authorizes the County to condition the granting of any such permits upon the provision of sufficient security as is deemed necessary to cover bridge maintenance or repairs that may be necessary Section 5 – Requires any applicant filing an “Application Permit to Exceed Posted Bridge Weight Restriction,” or similar application, to pay in advance the estimated costs to be incurred by the County to review such application, prepare any permits, and cover any engineering, legal or secretarial expenses incurred Section 6 – Authorizes the County to apportion the maintenance and restoration costs to be assessed in situations where more than one user applies for and obtains a permit to exceed the posted bridge weight restriction for a particular bridge. Section 7 – States that the County will erect and maintain road signs designating the weight restrictions of the bridges listed in Appendices I and II, as required by the Pennsylvania Vehicle Code; County reserves the right, by amendment to this Ordinance, to periodically update the load restrictions on said bridges; notice of updated load restrictions to be given on the County website 30 days in advance Section 8 – States that any person who violates any provision of this Ordinance will be prosecuted pursuant to Section 4902(a) of the Vehicle Code, and upon conviction will be sentenced to pay a fine in accordance with such section. Section 9 – Supersedes and repeals any previous Ordinance (or portion thereof) that is inconsistent with the terms of this Ordinance Section 10 - States that the terms of the Ordinance are intended to be severable if any Court declares a portion of said statute to be unconstitutional Copies of the full text of the proposed ordinance are available at the Commissioners’ Office at the Crawford County Courthouse, 903 Diamond Park, Meadville, Pennsylvania, at the law library at the Crawford County Judicial Center (adjacent to the Courthouse), or by visiting www.crawfordcountypa.net.
